How Can I Stop Law Suits, Garnishments, and Collectors?

Often it’s the upcoming lawsuit, foreclosure, wage garnishment, or never–ending collection calls that are the immediate impetus driving a debtor to seek bankruptcy relief.

The automatic stay immediately puts an end to creditor enforcement actions as soon as the case is filed. Once the case is submitted on–line, and a case number issued, our office sends notice to the foreclosure attorneys to pull the sale from the docket, contact the payroll department to stop the garnishment from the next paycheck, and file a notice with the court where the lawsuit is pending that the defendant is now under bankruptcy court protection.

If the lender continues the enforcement action after clear notification to them, the action is a violation of the court’s stay order and can result in damages, punitive damages and an award of attorney’s fees.
